
Minnesota’s mother was detained by the ice despite the judge’s order
Antonia Agilar Maldonado, a 25 -year -old Salvadorian woman, is still detention of ice in Minnesota more than two weeks after she was arrested by federal agents in St. Paul while she was on her way to work.
Aguila Maldonado, who lives in Lake Elmo, entered the United States without a legal status as a 17 -year -old minor who is not accompanied in 2016. She is now the mother of two American citizens, including a 22 -month nursing child. Her legal team says that she was seized without warning, shortly after her children left her way to work as a painter for their own account.
Her lawyers, Gloria Contreras Eden and Hannah Brown, say Agilar Maldonado is being held in Kandiohi Province in Wilmar, which includes ice detainees, although there is no criminal record, active asylum issue, and ties approved by a immigration judge.
According to her lawyers, on July 17, Agilar Maldonado and her husband were arrested and detained by internal security investigations (HSI), a section of the Ministry of Internal Security (DHS). The spouses were separated and transferred to various detention facilities. Auguilar Maldonado is currently being held in Kandiyohi Province, which includes ice detainees, although it is in a civil nursery, not criminal. Lawyers added that her husband has a separate lawyer and did not share more details about his case.
Braun and Constreras Eden says at the time of the arrest of Agilar Maldonado, agents were martyred by the old one against her. However, this matter was previously reopened and canceled by the immigration judge after he decided that he had not received any appropriate notice of a hearing when he was a teenager. They say since then, she is following the law, as she attended the court sessions and applied for asylum.
“There was an assumption that she had an order to remove, but this was incorrect. They claimed that it was the subject of their arrest, but she did not provide any other information other than that she made it clear that she did not have a criminal history,” said Contreras Eden said.
On July 31, the Mennisota immigration judge found that Agilar Maldonado is qualified to release a bond of $ 10,000. But ICE responded by providing automatic residency, as it prohibits its release under a new policy in the Ministry of National Security claiming that some migrants who entered the country without inspection are not qualified to obtain Bond, even if they entered as children and lived in the United States for years.
Her lawyers argue that this interpretation should not apply to its case, and that the Ministry of National Security is not fairly detained despite the judge’s order.
Both her lawyers say they are concerned about the circumstances she faces in prison as a profitable mother. They say that prison staff initially did not provide her with the breast pump; It was subsequently purchased by the employees. They say her milk has since turned green, and is worried about her child’s health.
“She is emotionally dispersed. She is crying repeatedly during our phone calls,” said Contreras Eden said. “She imagines this child who is crying, and imagines her child crying for his milk.”
Auguilar Maldonado managed to speak with her lawyer, and her family made attempts to reach her. Her children reside with aunt and uncle.
Brown and Constreras Eddin says Aguar Maldonado wants to share her story now in the hope of drawing the attention of the audience to her case and others like her.

“This is not the issue of arresting violent criminals to remove them from the country,” said Brown. “This is a place in the Ministry of Internal Security, who is aware of a nursing mother, took her from her child, her child, the little nursing, and a person who entered herself as a child, and a person who has no criminal history at all.”
Aguila Maldonado presented a petition for the garment, and asked a federal judge to order the Ministry of National Security to honor the bonds and release them so that it can continue the issue of asylum outside detention and return to caring for its children.
A federal judge set a hearing on August 12 on her case to address her request to obtain a temporary restriction that requires ICE to release her. The judge ordered the government to respond to its petition by Friday.
MPR News requested an interview with Aguilar Maldonado, but Contreras Edin said that the mother is currently very amazing to communicate effectively.
If he is released, Brown and Constreras Eddin says that Aguar Maldonado will continue in the procedures of the Immigration Court and attend the prescribed hearing.
MPR News Ice called for more details about the case. While the agency did not provide an official response as of publication, their spokesman said they were looking into the request.
